Fair Trading campaign aims to identify traders who provide illegal warranties

Warranties are separate from the automatic consumer guarantees that apply to many products and services you buy. A warranty is a voluntary promise offered by the person or business who sold the product or service to you. Once you buy the product or service, the promise becomes a right that can be enforced under the Australian Consumer Law (ACL).

Now NSW Minister for Fair Trading Anthony Roberts has launched a new campaign this month to help identify traders who are not providing accurate warranty information for their goods and services. Consumers are being encouraged to contact Fair Trading about manufacturers and suppliers who have not provided accurate or compliant warranty information regarding defects, as required under the Australian Consumer Law (ACL).

The CRVA Industry Pulse newsletter reports today that - "Members (of CRVA) should be aware that Fair Trading have asked for photographs or copies of any written warranty that does not contain the following phrase: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure".

"As Minister for Fair Trading, I am dedicated to achieving fairness for all in the marketplace and ensuring that the changing needs of our community are met", Anthony Roberts said.

"Consumers are best served by competitive markets where businesses can compete fairly in compliance with the legislation", he said. 

NSW Fair Trading (a division of the Department of Finance and Services) safeguards consumer rights, regulates specific industries and occupations, and advises traders on fair and ethical business practices.
